Terms of Use and GDPR

1. Service Description
DPPVisa is a SaaS platform that enables the creation of Digital Product Passports (DPP) compliant with the EU Ecodesign for Sustainable Products Regulation (ESPR) 2024/1781. The service includes passport creation, QR code generation, public passport pages, CSV import, and API access (depending on your plan).

2. Account Registration
You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You must be at least 18 years old or authorized to accept these Terms on behalf of your organization.
An individual or organization may not create multiple free accounts.

3. Plans and Pricing

• Free plan: Limited to 3 products; no credit card required.

• Paid plans: Starter, SME, Enterprise — billed monthly or annually.

• Prices are in EUR, excluding VAT where applicable. Prices will be converted based on the Central Bank of the Republic of Türkiye (CBRT) foreign exchange selling rate.

• You may change your plan at any time; changes will take effect in the next billing period.

• We reserve the right to change pricing by providing existing subscribers with 30 days’ prior notice.

4. Payment and Billing
Payments are securely processed by authorized payment systems.

Subscriptions renew automatically. You may cancel at any time.
If no passport has been created in the system, a refund may be issued within 14 days of the initial purchase.

5. Fair Use Policy
While your membership is active, you agree not to:

• Use the service for any unlawful purpose,

• Submit false or misleading product data,

• Attempt to exceed usage limits or bypass security measures,

• Reverse engineer or decompile the service,

• Use automated systems (bots) to access the service beyond the provided API,

• Resell access to the service without written authorization.

6. Data Ownership

• You retain ownership of all product data you enter into the service.

• By creating a public passport, you grant us a license to display the passport data on publicly accessible pages.

• You may delete your data at any time through your dashboard or by contacting us.

7. Compliance Disclaimer
Important: DPPVisa is an EU compliance assistance tool. Although we strive to keep our templates aligned with ESPR requirements, we do not guarantee regulatory compliance. Generated passports should be reviewed by a qualified regulatory consultant before being used for official compliance purposes. We are not responsible for regulatory decisions made solely on the basis of our tool.

8. Service Availability

• We target 99.9% uptime but do not guarantee uninterrupted service.

• Planned maintenance will be announced in advance whenever possible.

• We reserve the right to modify features with reasonable prior notice.

9. Limitation of Liability
To the maximum extent permitted by law, METIS SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

10. Termination
You may close your account at any time through your dashboard settings.
We may suspend or terminate accounts that violate these Terms.
Upon termination, your data will be retained for 30 days and then permanently deleted.

11. Governing Law
These Terms are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Aix-en-Provence, France.
